Third Party Software/ Materials

The optional PDF technology/ feature used by the Software is powered by PDF2SVG SDK copyright © PDFTron Systems Inc, 2001-2012, and distributed by Ixxus under licence. All Rights Reserved. In addition to the terms and conditions set out in the Licence, this third party software (the “PDF Software”) is subject to the following terms and conditions:

(A) You (i) will use the PDF Software only as an integral component of the Software licensed to you by Ixxus; (ii) will not use the Software for development, compilation, debugging and similar design-time purposes; (iii) will not reverse-compile or decompile, analyze, reverse-engineer, reverse-assemble or disassemble, unlock or otherwise attempt to discover the source code or underlying algorithms of the PDF Software or attempt to do any of the foregoing in relation to the object code of the PDF Software; and (iv) will not modify, adapt, translate or create any derivative works of the PDF Software.

(B) You will not use, copy, modify, or transfer the PDF Software, or any copy, adaptation, transcription, or merged portion thereof, except as expressly permitted pursuant to the terms of your Licence with Ixxus. Your rights to use the PDF Software are non-exclusive and non-assignable;

(C) Ixxus and its licensors will have the exclusive ownership of all right, title, and interest in and to the Software, including but not limited to the PDF Software, including ownership of all the intellectual property rights and confidential information pertaining thereto, subject only to the express rights and privileges expressly granted to you under the Licence;

(D) The PDF Software is provided “as is” without warranty or condition of any kind, either express or implied, including, without limitation, the implied warranties or conditions of merchantability or fitness for a particular purpose or durability and the warranty against infringement. Neither Ixxus nor PDFTron warrant that use of the PDF Software will be error-free or that use of the PDF Software will meet your needs. You represent that (i) you have the requisite expertise to evaluate the suitability of the PDF Software and that you have in fact undertaken your own investigation of the suitability of the PDF Software for your purposes; and (ii) you have relied upon your own skill and judgment in selecting the PDF Software for your purposes in accordance with and subject to the provisions of this Agreement.

The Software makes use of/ incorporates software owned by Reviewstudio (the “Reviewstudio Software”) which in addition to the terms and conditions set out in the body of this Licence, is subject to the following terms and conditions:

(A) You must only use the Reviewstudio Software as an integral part of the Software licensed to you by Ixxus.

(B) The user interface of the Reviewstudio Software and all rights therein, are owned exclusively by Reviewstudio and Reviewstudio retains all copyright and other rights therein.  All rights to the Reviewstudio Software and intellectual property embodied by the Reviewstudio Software are hereby expressly reserved.  You may not duplicate, copy or reuse any portion of the visual design or other elements of the Reviewstudio Software without express written permission of Reviewstudio.

(C) You must no modify, adapt or hack the Reviewstudio Software or modify another website so as to falsely imply that it is associated with the Reviewstudio Software or with Reviewstudio.

(D) You agree not to reproduce, duplicate, copy, sell or exploit any portion of the Reviewstudio Software without the express written permission of Reviewstudio.

(E) You understand that the technical processing and transmission of the Reviewstudio Software, including your content, may be transferred unencrypted and involve (i) transmissions over various networks; and (ii) changes to conform and adapt to technical requirements of connecting networks or devices.

(F) YOU EXPRESSLY UNDERSTAND AND AGREE THAT REVIEWSTUDIO SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES  INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTAGIBLE LOSSES (EVEN IF REVIEWSTUDIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM (I) THE USE OR INABILITY TO USE THE REVIEWSTUDIO SOFTWARE; (II)THE COSTS OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERRED INTO THROUGH OR FROM THE SOFTWARE; (III) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SOFTWARE; (V) ANY OTHER MATTER RELATING TO THE SOFTWARE.
